Service Agreement

OVERVIEW

This service agreement (the "Agreement") describes the terms and conditions applicable to your use of the Service provided by Slimco Ltd ("Company," "we, "us," and "our"), a company registered in England, registration number 11345193. The Service includes all services, communications and products that are made available by us now or in the future, including but not limited to all paid and unpaid online, telephone, remote, and in-person services, communications and products that we provide and/or offer to you (the "Service")

By accessing or using the Service, you agree to be bound by this Agreement as well as any additional terms and policies referenced herein and/or accessible via hyperlink on our website. If you do not agree with any part of this Agreement, then you may not access or use the Service.

The Service is intended for an adult population only, and you must be 18 years or older to access or use the Service. By using the Service, you represent and warrant that you are 18 years of age or older or of the legal age of majority in your country, state, or province of residence. If you are not 18 years of age or older, then you may not access or use the Service.

This page contains the most recent version of the Agreement. We reserve the right to update, modify, or replace any portion of the Agreement by publishing updates and/or changes on our website. It is your responsibility to check this page periodically for any changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these terms and conditions. 

 

SECTION 1 - SERVICE PROVISION

The Company provides nutritional therapy services, which is an evidence-based approach and aims to optimise one's health potential through individually tailored dietary and lifestyle modifications. Nutritional therapy services are provided by Normund Barons RD, BSc (Hons), a registered dietitian (the "Practitioner"). This generally includes an assessment of individual needs and concerns, recommendations of appropriate nutrition strategies, monitoring of progress, and evaluation of outcomes. Nutrition therapy may be provided remotely via telephone or video conferencing, as well as in person at Battersea Park Clinic.

The Company makes no guarantees concerning results from the Service. While it is our goal to help you reach your health goals, nutritional therapy does not guarantee a cure for any condition or illness and may not be suitable for everyone. As with any health-related programme or service, individual results vary greatly and will often depend on the patient’s effort and cooperation in and outside of the sessions.

Additionally, the Company may offer other services and/or products from or through third-party providers. These third-party service providers are not employees of the Company, and you acknowledge that by engaging with them, you are entering into an agreement with them. You should carefully evaluate third-party service providers to ensure they hold the necessary qualifications and standards before entering into agreements with them. The terms of engagement for these third-party services will be separately agreed upon between you and the provider. The Company is not responsible for any loss, damage or injury caused by third-party services or products. You should ensure that you read and understand the terms of engagement with third-party providers prior to entering into a transaction with them.

 

SECTION 2 - BOOKING PROCESS AND PAYMENTS

We normally require you to complete the Patient Intake Questionnaire and/or any other forms deemed appropriate by the Practitioner before your appointment. The completed forms should be returned via the client portal or the phone app no later than 48 hours prior to your appointment time.

The Service must be booked and paid in advance, either directly through the Company’s website or by contacting us via telephone. Bookings are subject to availability, and confirmation of your booking will be provided upon payment of a non-refundable deposit of £30. The deposit will be used as part of the payment towards your booking. Once payment is received, you will receive an email confirming your appointment time, date, and location (if applicable).

Before booking an appointment, it is important to understand the pricing structure for the Service. We require that you familiarise yourself with our pricing structure before making a booking. This can be done by visiting our website or by contacting the Practitioner directly. If you are booking through a third-party provider, please refer to the terms of engagement set out by that provider.

 

SECTION 3 - APPOINTMENTS

As a courtesy, the Company may provide appointment reminders before the scheduled appointments, however, they are not guaranteed. It is important to remember that even if you do not receive reminders for your appointment, you should still attend. It is your responsibility to ensure they keep their appointment and arrive on time.

If you are running late, it is important to contact us as soon as possible so that alternative arrangements can be made. We request that each patient arrives at their appointment on time in order to make the best use of the allocated session. The Practitioner will be unable to extend the allocated session if you arrive late, however, they may still be able to provide a service if you do arrive late, provided there is sufficient time remaining in the session.

In circumstances where a patient has failed to attend their appointment without providing adequate notice and/or explanation, we reserve the right to retain any deposits paid in connection with that appointment.

We reserve the right to cancel or rearrange any appointment if the Practitioner deems it necessary. If an appointment is cancelled by the Practitioner, we will make all reasonable endeavours to offer alternative arrangements.

In circumstances where the Practitioner has made an appointment arrangement but the patient has failed to arrive, we reserve the right to retain any deposits paid in connection with that appointment.

The assessment may involve body composition measurements that require physical contact between the Practitioner and the patient. Before any such contact is made, the Practitioner will obtain your express consent. If you do not wish to provide this consent, please make sure to inform your Practitioner prior to the beginning of the session.

The duration of consultations can vary based on the type of service being provided. The length of each consultation will depend on the complexity of the issues being addressed and the services provided. Typically, sessions last between 45 and 60 minutes. Before making an appointment, you should ensure that you understand the duration of your consultation. You can do so by visiting our website or by inquiring with the Practitioner.

 

SECTION 4 - CANCELLATIONS, RESCHEDULING AND REFUNDS

If you need to reschedule or cancel your appointment, we require 48 hours notice. Late cancellations will incur a cancellation fee, which is the cost of the deposit, so please be sure about your appointment time before booking your consultation. Occasionally, we may, at our sole discretion, waive the cancellation fee, but we are under no obligation to do so.

We understand that emergencies can arise which may prevent you from attending your appointment. If you are unable to attend due to an emergency, please contact us as soon as possible so we can attempt to reschedule or amend your booking.

The services purchased have a validity of 12 months from the date of purchase. This includes, but is not limited to programmes, consultations (in person or remotely), and other services provided by us. No refunds will be issued if you fail to use the service within 12 months of purchase.

Before purchasing the service, it is important to ensure that you are happy to use the Service as no refunds will be issued once the Service is purchased. It is important to consider all aspects of the Service Agreement, such as bookings and payment process, cancellations and rescheduling policies, potential refusal of access to the service, and the validity of any purchased services.

Please note that in certain circumstances, such as medical emergencies, we may require you to cancel or reschedule your appointment. In such cases, we will reschedule your appointment at no additional cost or issue you a full refund, including the deposit paid.

 

SECTION 5 - MODIFICATIONS TO SERVICE AND PRICES

We reserve the right to modify or discontinue any service, including prices of services at any time. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Continuing to use the Service following the posting of any changes constitutes acceptance of those changes. We, therefore, urge you to periodically review this document for any such updates. If at any time you disagree with any part of these terms, please cease using the Service immediately.

Any prices posted on our website and in any Service Agreement are subject to change without notice. Prices of any services purchased through the Service are effective at the time they are purchased. We reserve the right, at our sole discretion, to update or revise these terms and conditions from time to time.

 

SECTION 6 - PERSONAL DATA

As part of the nutritional therapy services, you may be asked to provide information concerning your physical habits, medical history, moods, energy levels, likes and dislikes, lifestyle, diet, and other information as deemed necessary by the Practitioner. This information is collected so that we can provide you with the Service. This information will be kept confidential and will not be released or disclosed to third parties without your prior consent, unless required by law.

We take your privacy and the security of your personal data very seriously. All personal data is collected, stored and processed in accordance with the current legislation and our Privacy Policy. We are committed to protecting your data and will only use it for the purposes outlined in these documents. By obtaining the Service from us, you agree that we may store, process and use your personal data in accordance with the Privacy Policy.

We will only store and process your personal data for as long as is required to provide the service you have requested or engaged with us for, as well as for any other purposes specified in our Privacy Policy. After this period, we will only continue to store and process your data for as long as required by law and in accordance with all applicable laws and regulations.

It is the patient's responsibility to inform us if any changes occur to their personal information, including medical information. We strongly encourage you to keep us updated with any changes to your information at your earliest convenience.

 

SECTION 7 - COMPLIMENTS AND COMPLAINTS

We strive to provide you with the highest quality service. We welcome any compliments and feedback you may have about our services. Should you wish to make a comment or complaint, please contact us via our website or you can write to us at the address provided.

Your feedback is important to us and we strive to respond to all comments or complaints promptly. We take any complaint very seriously and will endeavour to resolve it as quickly as possible. If we cannot resolve the complaint within a reasonable timeframe, we may refer you to an independent dispute resolution service.

 

SECTION 8 - INTELLECTUAL PROPERTY RIGHTS 

Slimco® is a registered trademark. Slimco Ltd is the sole owner of the trademark. Unauthorised use is prohibited. Any unauthorised use of the Slimco trademark and/or brand will result in criminal prosecution.

 

SECTION 9 - LIMITATION OF LIABILITY

Except as otherwise provided in this Agreement, we shall not be liable for any damages arising from or related to your use or inability to use the Service. This includes but is not limited to direct, indirect, special, punitive and consequential damages. We shall also not be liable for any damage caused by the inappropriate use of our services or any failure to follow the instructions provided. We are also not liable for any damage caused by personal injuries resulting from the use of our services.

 

SECTION 10 - SEVERABILITY

 If at any time, any provision of this Agreement is or becomes invalid, illegal or unenforceable in any respect under applicable law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

 

SECTION 11 - TERMINATION

We may suspend or terminate your access to the Service, in whole or in part, for any reason and at any time at our sole discretion. This includes but is not limited to if you breach this Agreement or if we are no longer able to provide the Service. We will not be liable to you or any third party for termination of service.

 

SECTION 12 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any rights or provisions of the Agreement shall not constitute a waiver of such rights or provisions. This implies that any non-enforcement does not mean that we are giving up our rights or abandoning them in any way. We reserve the right to restart enforcing our rights at any given point in time.

This Agreement constitutes the entire agreement between us and governs your use of the Service, superseding any prior agreements between us (including, but not limited to, any prior versions of this Agreement). You also may be subject to additional terms and conditions that may apply when you use or purchase certain other services from us.

 

SECTION 13 - GOVERNING LAW

These Terms of Use, as well as any separate agreements under which we provide you Services, will be governed and construed in accordance with the laws of England and Wales. These Terms of Use shall be interpreted according to the laws of England and Wales without regard to any conflict or choice of law principles. The courts located in England and Wales shall have exclusive jurisdiction over any and all disputes arising out of or related to this Service Agreement.

 

SECTION 14 - DISCLAIMER OF MEDICAL ADVICE

Nutritional therapy and dietary advice are not intended to be a substitute for medical diagnosis or advice. It is the responsibility of the patient to seek further medical advice from a physician and/or appropriate healthcare provider if his/her condition or symptoms require it. By using our Service, you acknowledge that we do not diagnose diseases, disorders or conditions, we are not providing medical advice or diagnosis, and our Services are not to be used for such purposes.
